Resignation of Contract Employees: Rights, Penalties, and Compensation You Must Understand

Resigning as a contract employee may sound simple, but did you know that there are rights, penalties, and compensation to consider before taking this step? Make sure your decision to resign does not lead to adverse consequences.

Rights and Obligations of Contract Employees

A Fixed-Term Employment Agreement (PKWT) is made based on an agreement between the employee and the company in accordance with the Labor Law and Government Regulation No. 35 of 2021. Under this contract, employees are obligated to complete their employment term as agreed unless certain conditions necessitate resignation.

Consequences of Resigning Before the Contract Ends

If a contract employee resigns before the agreed term ends, the following consequences may apply:

  • Penalties: The company may impose a penalty if stipulated in the contract.
  • Compensation: Employees resigning prematurely are not entitled to benefits such as severance pay but are still entitled to rights such as unpaid wages.

Rights of the Company and the Employee

The company has the right to seek damages if an employee breaches the contract. However, the company must also comply with regulations regarding employee entitlements, such as holiday allowances (THR), leave, or prorated salaries if applicable.

The Importance of Understanding Employment Contracts

Both employees and companies must thoroughly understand the contents of the employment contract before agreeing. This is crucial to avoid future disputes.

By understanding the rules surrounding resignation, employees and companies can fairly fulfill their rights and obligations in accordance with the law.

RedNote: The Trending TikTok Replacement App – How Safe Is It?

The potential ban of TikTok in the United States has led to rival social media platforms reaping the benefits. One such platform is the Chinese app Xiaohongshu, better known as RedNote.

Founded in 2013 by Charlwin Mao and Miranda Qu, RedNote allows users to share lifestyle-related photos and videos, such as travel tips, fashion, and food.

Since the announcement of TikTok’s potential ban in the U.S. on January 19, 2025, RedNote has seen a significant surge in downloads on the U.S. App Store. TikTok users in the U.S. have started migrating to RedNote, making it the number one app on the App Store as of January 13, 2025.

Although widely popular in China, boasting around 300 million users, RedNote has remained relatively unknown internationally. However, with the migration of TikTok users, the app is now gaining international attention. RedNote offers content-sharing features similar to Instagram and TikTok but emphasizes lifestyle recommendations and community engagement.

RedNote ranks first as the most downloaded app on the US App Store.

Data security is a key concern for users transitioning to RedNote. While there have been no significant reports of data breaches by RedNote, users are advised to remain cautious and familiarize themselves with the app’s privacy policies.

Beware of Online Gambling Job Listings: Ministry of Manpower Takes a Stand, Jobstreet Acts!

The Ministry of Manpower (Kemnaker) urges the public to exercise caution and discretion when seeking job information, especially through digital platforms.

This warning follows the viral circulation of a job listing on Jobstreet linked to online gambling businesses. A netizen with the username @navereasy discovered an admin position offering a salary of IDR 18 million per month, which upon further investigation turned out to be an admin job for online gambling operations in Cambodia.

Initially, the job was advertised by a company called Trend Network Technology on Jobstreet. Despite its high salary, further follow-up emails revealed that the position required relocating to Cambodia.

As a result, Jobstreet by Seek Indonesia deactivated the listing after the company failed to provide clarification.

The Ministry of Manpower’s spokesperson, Sunardi Manampiar Sinaga, emphasized the importance of verifying job information through official company websites or contacting the company directly. Legitimate recruitment processes, he noted, never require applicants to pay fees.

Indicators of fraudulent job listings include:

  • Unreasonably high salaries for unspecified positions.
  • Use of unofficial email addresses (e.g., generic domains like @gmail.com).
  • Lack of clear details about the company address, job responsibilities, or logical requirements.
  • Requests for money transfers for administrative or training fees.
  • Non-transparent recruitment processes, such as instant interviews via chat.

Kemnaker has urged job portal platforms to enhance the verification of job postings to protect job seekers from scams. The ministry also provides an official complaints channel through its website or hotline at 1500 630.
