Want to Hire Foreign Workers in Indonesia? Here Are the Requirements!

Indonesia, as a growing developing country with a continually expanding economy, attracts many foreign workers (TKA) across various sectors. However, specific rules and requirements must be met by TKA who wish to work in Indonesia. These regulations are governed by several laws, including the Labour Law.

Below are some key requirements that employers and TKA must fulfill:

1. Education and Competence
  • TKA must have qualifications relevant to the position they will occupy.
  • Possess a competency certificate or at least five years of work experience relevant to the role.
2. Foreign Worker Utilization Plan (RPTKA)
  • Employers are required to have an RPTKA approved by the Ministry of Manpower.
  • The RPTKA includes information about the employer’s identity, reasons for hiring TKA, the role to be filled, the number of TKA, duration of employment, and the work location.
3. Foreign Worker Employment Permit (IMTA)
  • Once the RPTKA is approved, employers must apply for the IMTA as the official permit to hire TKA.
4. Supporting Documents
  • A copy of the TKA’s passport.
  • Tax Identification Number (NPWP) for TKA working more than six months.
  • Proof of labor reporting at the company.
5. Other Obligations
  • Employers must appoint an Indonesian worker to accompany TKA for knowledge and skill transfer.
  • TKA can only be employed for specific positions and within a designated period per prevailing regulations.

Adhering to these requirements and procedures is crucial to ensure the legality and smooth process of employing TKA in Indonesia. Read more here.
