Overtime Pay: How to Calculate Overtime According to Labor Regulations

For many employees in Indonesia, overtime has become part of their work routine. Whether due to strict company targets or urgent operational needs, employees are often required to work beyond normal working hours. On the other hand, companies must understand the rules regarding overtime pay to avoid misunderstandings between workers and management.

This article will discuss how to calculate overtime pay according to Indonesian labor regulations, and how the role of outsourcing companies and employment agencies in Indonesia ensures transparency of employee rights.

Legal Basis for Overtime Pay in Indonesia

Overtime regulations are stipulated in the Manpower Law and further detailed in Government Regulation No. 35 of 2021. According to these rules, normal working hours are:

  • 7 hours per day and 40 hours per week for a 6-day workweek.
  • 8 hours per day and 40 hours per week for a 5-day workweek.

If an employee works beyond these hours, the company is obliged to pay overtime wages accordingly.

Formula for Calculating Overtime Pay

Calculating overtime pay cannot be done arbitrarily. The government has established an official formula as follows:

  1. Calculate Hourly Wage
Hourly wage = 1/173 × Monthly salary The figure 173 is derived from the average number of working hours in a month.
  2. Overtime Formula
    • First hour of overtime = 1.5 × hourly wage
    • Subsequent hours = 2 × hourly wage

Example:
An employee with a monthly salary of Rp5,000,000 works 3 hours of overtime.

  • Hourly wage = 5,000,000 / 173 = Rp28,902
  • First hour = 1.5 × 28,902 = Rp43,353
  • Second hour = 2 × 28,902 = Rp57,804
  • Third hour = 2 × 28,902 = Rp57,804

Total overtime = Rp158,961

Employees Entitled to Overtime Pay

Not all positions are eligible for overtime pay. The regulations state that managerial-level employees or those responsible for overseeing company operations are not entitled to overtime. Overtime pay generally applies to operational staff, clerical workers, or contract employees.

This is where the role of an employment agency or outsourcing company becomes crucial. With proper workforce management, agencies ensure that employment contracts, salary calculations, and overtime payments comply with the applicable laws.

Although the rules are clear, real-world practices often differ. Some common challenges include:
